2.1 Jobpartners or their licensees own all copyright, database rights and all similar rights in this Site and the information contained in it. You may use the information and reproduce it in hard copy for your personal reference only. Any copy of the information that you make must retain all copyright and other proprietary notices shown on the initial download or print-out.

2.2 All content, graphics and trademarks contained in this Site including but not limited to Jobpartners, jobpartners.com, ActiveRecruiter.com & ActiveRecruiter, are the property of Jobpartners (except those belonging to third parties and included by their permission) and may not be used without written permission.

2.3 You agree to notify us in writing promptly upon becoming aware of any unauthorised access to or use of the Site by any party or of any claim that the Site or any of the contents of the Site infringes any copyright, trade mark, or other rights of any party.

3. USE OF SITE

3.1 You are wholly responsible for access and use of the Site by any person using your terminal or point of presence and you must ensure that any such person fully complies with these Terms.

3.2 You agree to access and use the Site in a manner consistent with all applicable laws and regulations in the country from which you have accessed the Site.

3.3 The Site and the information are provided "as is" excluding any warranties, promises or guarantees of any kind, either express or implied, to the fullest extent permissible by applicable law including (but not limited to) the exclusion of warranties of title, merchantability, satisfactory quality, fitness for a particular purpose and non-infringement of proprietary or third party rights. We do not accept responsibility or liability for functions contained on the Site and make no warranties regarding the accuracy, timeliness or completeness of the information or that the Site will operate uninterrupted or error-free or that defects will be corrected.

3.7 You assume sole responsibility for the selection by you of materials on the Site. We are not responsible for actions or decisions taken by you following use of our services, including without limitation CV creation and profile creation services, or for use of Jobpartners Consulting or Methodologies, or for any decisions or other consequences arising from these actions and decisions, whether directly and indirectly.

3.8 In no event shall Jobpartners be responsible for any loss or damage of whatever kind arising out of access to or use of or reliance on any information posted on, or advice available through, the Site or any hypertext link to any Web site or any information contained on or accessed through such web site.

4. PRIVACY POLICY

4.1 We may hold and process personal information obtained about you when you access the Site and use it to identify opportunities and other products and services which may be relevant to you, to evaluate the effectiveness of our marketing and for statistical analysis.

4.2 We respect any personal information that you provide and undertake to comply with the Data Protection Act 1998 ("the Act") and any other UK data protection legislation from time to time in place.

4.3 You should be aware that if we are requested by the police or any regulatory or government authority investigating suspected illegal activities to provide information concerning your activities whilst using the Site we shall do so. We will comply with any legal requirements to disclose personal data held by us.

4.4 In addition to the circumstances described in Clause 4.3, we will not disclose personal information except under a strictly confidential basis to sub-contractors or persons acting as our agents and to any person who may assume our rights in respect of this Site.

4.5 We may also occasionally transfer your personal data to countries outside the European Union, which may not provide the same level of protection for personal data as within the EU. In doing so we undertake to comply with the provisions of the Act.

4.6 The Site also logs IP addresses for systems administration purposes. IP addresses are logged to track a user's session. This enables us to determine which parts of the Site users are visiting. We do not link IP addresses to anything personally identifiable. This means that a user's session will be tracked, but the user will be anonymous.

4.7 All personal data whether held by Jobpartners or by its sub-contractors or agents will be afforded a high level of protection against unauthorised or accidental disclosure, access or deletion. By agreeing to these Terms you agree to such data being so used and that it may be transmitted to others as stated above.

5. APPLICABLE LAWS

5.1 The Site is not directed at any person in any jurisdiction where for any reason the publication or availability of the Site or content is prohibited. Those in respect of whom such prohibitions apply must not access the Site. We do not represent that either the Site or the information are appropriate for use or permitted by local laws in all jurisdictions. Those who access the Site do so on their own initiative and are responsible for compliance with applicable local laws or regulations; legal advice should be sought in cases of doubt.

5.2 The Terms are governed by the laws of England and Wales and the parties submit to the exclusive jurisdiction of the English courts.
